This Privacy Policy ("Policy") describes how Fitsorate ("Company", "we", "us", or "our") collects, protects, uses, and shares the personal information and health-related data of users ("User", "you", "your") of the Fitsorate mobile application ("App"), our website located at fitsorate.com, and all associated services, features, and content offered by the Company (collectively, the "Services").

By accessing or using our Services, you acknowledge that you have read, understood, and agreed to the practices described in this Privacy Policy. If you do not agree with this Policy, you must immediately discontinue your use of the Services.

  • Health & Fitness Data: Nutritional logs, calorie counts, metabolic rates, biometric inputs (weight, height, age, gender), hydration tracking logs, and active fitness logs.

2. INFORMATION COLLECTION AND USE

We collect several different types of information for various purposes to provide, monitor, and improve our Services to you.

A. Personal Data

While using our Services, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to:

  2. First name and last name
  3. Age, date of birth, and gender identity
  4. Biometric and physiological details (including current weight, target weight, height, body fat percentage, and activity levels)

B. Health, Diet & Fitness Metadata

Due to the native coaching and calculation characteristics of our App, we process highly specific fitness-related details to provide accurate calculations. This includes:

  1. Daily meal entries, ingredient weights, calorie metrics, and macronutrient breakdowns (protein, fats, carbohydrates).
  2. Physical exercise records, duration of activities, repetitions, weight loads, and training styles.
  3. Daily water consumption records and sleep tracking details.
  4. AI Coach chat logs, conversational history, custom diet queries, and specific fitness request text blocks.

C. Usage Data & Analytics

When you access the Services via a mobile device, we may collect certain information automatically, including, but not limited to:

  • The type of mobile device you use, your mobile device unique ID, and the IP address of your mobile device.
  • Your mobile operating system, the type of mobile Internet browser you use, unique device identifiers, and other diagnostic data.
  • Crash reports, log files, screen transition speed, and specific session interaction details.

3. LEGAL BASES FOR PROCESSING

Our legal basis for collecting and using the personal information described in this Policy depends on the Personal Data we collect and the specific context in which we collect it. We process your data under the following conditions:

  1. Performance of a Contract: Processing is necessary to fulfill our service commitments to you.
  2. Consent: You have given us explicit consent to process your sensitive health and biometric data to generate personalized nutrition goals.
  3. Legitimate Interests: To perform diagnostic analysis, improve algorithms, secure the cloud infrastructure, and protect against fraudulent behaviors.
  4. Compliance with Law: To comply with legal, tax, or regulatory mandates.

4. DETAILED PURPOSE OF DATA PROCESSING

Fitsorate uses the collected data for various operational, optimization, and analytical purposes:

  • To set up, configure, maintain, and securely manage your user account.
  • To calculate accurate metabolic rates (BMR/TDEE) and continuously adjust macro target goals.
  • To train, optimize, and execute our context-specific AI Coaching engines to provide tailored responses to your dietary logging queries.
  • To allow you to monitor and visualize historic progress trends via interactive charts and telemetry dashboards.
  • To provide customer care, support, and troubleshoot performance errors or unexpected server delays.
  • To detect, prevent, and address technical issues, app security vulnerabilities, or unauthorized access attempts.

5. DATA SHARING AND DISCLOSURE

We hold your data in high confidence. The Company does NOT sell, trade, or rent your sensitive health or personal data to data brokers or third-party advertising companies. We may disclose your data only under the following strict scenarios:

A. Third-Party Service Providers

We engage trusted third-party corporations and individuals to facilitate our Services, host databases, process secure payments, or perform diagnostics (such as database and cloud hosting infrastructure providers). These third parties have access to your Personal Data only to perform these specific tasks on our behalf and are strictly obligated not to disclose or use it for any other purpose.

B. Business Transactions

If the Company is involved in a merger, acquisition, asset sale, or restructuring, your Personal Data may be transferred as a business asset. We will provide notice before your Personal Data is transferred and becomes subject to a different Privacy Policy.

C. Law Enforcement & Legal Obligations

  • However, please be advised that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

7. DATA RETENTION AND ACCOUNT DELETION

The Company will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies.

You can request the permanent deletion of your account and all associated metrics, food logs, and chat records directly from the settings panel within the App, or by submitting a formal deletion request via email to fitsorate.team@gmail.com. Upon verification, all corresponding personal data will be purged from our active systems within 30 days, subject to statutory retention overrides.

8. CHILDREN'S PRIVACY

Our Services do not address anyone under the age of 13 ("Children"). We do not knowingly collect personally identifiable information from anyone under the age of 13. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we will take immediate steps to remove that information from our cloud servers.

9. CHANGES TO THIS PRIVACY POLICY

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last updated" date at the top of this document.
